By downloading, installing, or using CardPick, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the app. You must be at least 13 years of age to use CardPick. By using the app, you represent that you meet this requirement.
CardPick is a personal finance tool that helps you identify which credit card in your wallet earns the most rewards for a given spending category. The app stores card information locally on your device and does not connect to any financial institution on your behalf.
CardPick provides informational suggestions based solely on the reward rates you enter manually. Nothing in this app constitutes financial, investment, legal, or tax advice. Always consult a qualified financial professional before making credit or financial decisions. We are not responsible for any financial outcomes resulting from your use of the app.
Reward rates, categories, and card details displayed in CardPick are entered and maintained by you. We make no representations or warranties about the accuracy, completeness, or timeliness of the information. Card issuers may change their reward structures at any time without notice.
CardPick offers an optional Pro subscription purchased through the App Store. Subscriptions are managed entirely by Apple. Refund requests must be submitted directly to Apple. Cancellation of a subscription takes effect at the end of the current billing period.
All content, design, and code within CardPick are the property of Dual Node Labs and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written permission.
CARDPICK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
To the maximum extent permitted by law, Dual Node Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use CardPick, even if advised of the possibility of such damages. In no event shall our total cumulative liability to you exceed the greater of (a) the amount you paid for CardPick Pro in the twelve months immediately preceding the claim, or (b) zero dollars ($0.00).
You agree to indemnify, defend, and hold harmless Dual Node Labs, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of CardPick; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of CardPick that cannot be resolved informally shall be resolved by binding individual arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, rather than in court. YOU AND DUAL NODE LABS EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.
Exceptions: Either party may bring an individual claim in small claims court if it qualifies. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court to prevent imminent harm.
Opt-Out: You may opt out of arbitration by notifying us in writing at cardpick@dualnodelabs.com within 30 days of first accepting these Terms. Your opt-out notice must include your name and a clear statement that you wish to opt out of arbitration.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute not subject to arbitration under Section 10 shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions will continue in full force and effect.
We reserve the right to modify these Terms at any time. Continued use of the app after changes are posted constitutes acceptance of the revised Terms. For material changes, we will update the date at the top of this page.
